El derecho a la salud y la prohibición de regresividad: ¿infringen las restricciones para inmigrantes el contenido esencial?*

    A partir de la discusión en torno a la regresividad de los derechos y los límites a su justificación, este trabajo trata de delimitar cuándo las medidas regresivas que afectan a la titularidad del derecho a la salud pueden quedar justificadas y cuándo, por el contrario, no se cumplirían requisitos previos como la legitimidad del fin y el respeto del contenido esencial del derecho. Se estudia si la reducción del gasto puede suponer un fin legítimo para establecer regresiones y se sugiere una definición del contenido esencial del derecho a la salud a partir de la doctrina del Comité de Derechos Económicos, Sociales y Culturales de Naciones Unidas.

    Estos parámetros se aplican, con posterioridad, al análisis de la regresividad que supuso el Real Decreto-ley 16/2012, de 20 de abril, lo cual permite situar a las medidas restrictivas para el acceso a la sanidad de los inmigrantes en situación irregular en entredicho.

    From the discussion on the prohibition of regressive measures and the limits to its justification, this paper attempts to determine when restrictive measures for the access to the right to health can and cannot be justified, depending on whether requisites such as the legitimacy of the end of the norm and the respect for the minimum core of the right are infringed. The work analyses if the reduction in public expenditure can be considered as a legitimate end as well as suggests a definition of the minimum core of the right to health from the doctrine of the Committee on Economic, Social and Cultural Rights of United Nations.

    These parameters are applied to the analysis of the Spanish Royal Decree-law 16/2012, 20th April, calling the restrictive measures imposed for undocumented immigrants into question.
