    Se ha dicho por la doctrina española que uno de los temas fundamentales que se plantean en la teoría general del derecho es la sucesión de leyes en el tiempo. Como resultado de tal sucesión, se cuestionan las consecuencias y efectos de la afección de una ley a situaciones constituidas con anterioridad a su vigencia. Muchos son los autores españoles y extranjeros que se han enfrentado al tema de la retroactividad de las normas jurídicas, existiendo excelentes estudios doctrinales sobre dicho tema. La presente investigación tiene como objetivo principal ofrecer una nueva visión del asunto a partir de la determinación del verdadero campo de aplicación de la ley nueva retroactiva. Para conseguir este objetivo es fundamental detenerse en el análisis de la eficacia jurídica.

    It has been said by the Spanish doctrine that one of the fundamental issues that arise in the general theory of law is the succession of laws over time. As a result of such succession, the consequences and effects that can have a law in regard to situations constituted prior to its effective date have been brought into question. Many Spanish and foreign authors have faced the issue of retroactivity of legal norms, so that there exist excellent doctrinal studies on this subject. The main goal of this investigation is to offer a new vision of the matter from the starting point of the determination of the true field of application of the new retroactive law. To achieve this objective, it is essential to elaborate in the analysis of the legal effectiveness.
