Competencia judicial internacional, reconocimiento y ejecución de resoluciones judiciales en materia civil y mercantil: La convivencia del Reglamento 1215/2012 con el Convenio de Lugano de 2007

    Este trabajo tiene por objeto el análisis de las relaciones de convivencia entre el Reglamento 1215/2012 y el Convenio de Lugano de 2007, ambos reguladores de la competencia judicial internacional, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil, a través del estudio de sus cláusulas de compatibilidad, el art. 73 R. 1215 y el art. 64 CL 2007. Por un lado, tenor, alcance y juego de ambos preceptos: art. 73 R. 1215 y 64.1 CL 2007. Por otro, las relaciones de prevalencia entre ambos instrumentos en el ámbito de la competencia judicial internacional (art. 64.2.a CL 2007), la litispendencia y conexidad (art. 64.2.b CL 2007) y el reconocimiento y/o la ejecución de resoluciones judiciales (art. 64.2.c CL 2007). Y, finalmente, el estudio de la regla especial del art. 64.3 CL 2007 operativa en sede de reconocimiento y ejecución de resoluciones.

    This work analyzes the relationship between Regulation 1215/2012 and 2007 Lugano Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters by the study of the rules provided to, the art. 73 R. 1215 and the art. 64 LC 2007. On the one hand, the analysis of the relationship between these two provisions: art. 73 R. 1215 y 64.1 LC 2007. On the other, the priority between instruments on the scope of international jurisdiction (art. 64.2.a LC 2007), on lis pendens and related actions (art. 64.2.b LC 2007) and on recognition and enforcement of foreign judgments (art. 64.2.c LC 2007). Finally, the analysis of the special rule contained in art. 64.3 LC 2007 relevant on recognition and enforcement of foreign judgments.
