Resumen de El amparo en El Salvador: finalidad y derechos protegibles

  El presente artículo aborda la temática de la finalidad del amparo, con el objeto de esclarecer que además de la tradicional dimensión subjetiva, existe otra de tipo objetivo que se caracteriza por trascender al caso concreto, pues los criterios que emanan de la interpretación de las disposiciones constitucionales que sirven para resolver éste, se convierten en criterio cierto que orienta la interpretación y aplicación de los derechos fundamentales por parte de los órganos del Estado. Asimismo, hace una aproximación a uno de los temas inacabados en materia de amparo: el relativo a los derechos protegibles por el mismo, lo cual es consecuencia de la amplia formulación contenida en el artículo 247 de la Constitución, que incluye a "los derechos que otorga la presente Constitución". En razón de eso, la Sala de lo Constitucional se ha visto en la necesidad de perfilar los contornos de dicha expresión y sistematizar el contenido de los derechos que han sido interpretados por ella.

  The aim of this article is to address in the first place the purpose of the Amparo, in order to clarify, that in addition to the traditional subjective dimension it pertains there is another object type, characterized by going beyond the particular case, due to the criteria that arises from the interpretation of the constitutional provisions which serve to overcome this, it has become a criterion that guides the interpretation and application of the fundamental rights by other state bodies. And, secondly, it is an approximation to one of the unfinished terms of Amparo, as it is related to the rights concerning the protected rights, which is a consequence of the broad formulation establish in Article 247 of the Constitution, which includes "the rights granted by this Constitution." Because of that, the Constitutional Chamber has been in the need to gradually shape the contours of the constitutional expression and systematize its content of rights that have been interpreted by it.
