    O texto que segue sugere uma explicação sobre a busca pela verdade em confronto com a imparcialidade do juiz no processo penal. Nesse caso, expõe-se uma crítica ao modo como se apresenta o problema da imparcialidade do magistrado ligada por uma visão de quebra na interpretação quanto à estrutura acusatória do processo penal, esquecendo-se, em verdade, que o que se deve é fortalecer o controle da investidura do juiz, utilizando-se de outros institutos necessários para a efetivação da garantia judiciária e confiança coletiva e individual nas decisões prolatadas pelo juiz penal. Razão de se trazer alguns exemplos de como se confrontar a busca da verdade junto da imparcialidade do juiz atribuindo-se outros mecanismos, como é o caso da divisão entre juízes de instrução e julgamento ocorrido em alguns países da Europa Continental e, especificamente, na legislação portuguesa.

    This paper suggests an explanation of the search for truth in conflict with the impartiality of the judge in criminal procedure. In this case, it exposes a critical as they study the problem of the impartiality of the judge only by the sight of a possible break in interpretation as accusatory (adversarial) system of criminal procedure, forgetting to strengthen the control of the judge’s investiture, using from other means for effective judicial guarantee and the notion of individual and collective confidence in the decisions handed down by the criminal court. Reason to bring some examples of how to confront the search for truth with the judge’s impartiality use of other means, such as the division between investigating judges and trial in some countries of continental Europe and, specifically, in the Portuguese criminal law
