    Este trabajo estudia el delito de trata de seres humanos del artículo 177 bis CP, tras la reforma penal por LO 1/2015, destacando las principales novedades introducidas en la misma, desde una perspectiva crítica. En este estudio se analiza el tipo básico del delito, atendiendo al bien jurídico, la conducta típica, los sujetos y los medios comisivos típicos y, finalmente, el tipo subjetivo, constituido por las distintas finalidades de explotación. En segundo lugar se abordará la exégesis de los tipos agravados, tratando de fundamentar tal exasperación punitiva. En el análisis dogmático de esta figura delictiva se prestará especial atención a la irrelevancia del consentimiento de la víctima, la punibilidad de los actos preparatorios, la autoría y la participación, los controvertidos problemas concursales, la reincidencia internacional y, finalmente, la excusa absolutoria para la víctima de trata de seres humanos.

    This paper studies the crime of human trafficking of article 177 bis CP, after the criminal reform by LO 1/2015, highlighting the main novelties introduced in it, from a critical perspective. In this study, the basic type of crime is analised, taking into account the juridical good, the typical behavior, the subjects and the typical commissary means and, finally, the subjective type, constituted by the different purposes of exploitation. Second, the exegesis of aggravated types will be addressed, trying to ground such punitive exasperation. In the dogmatic analysis of this criminal figure, special attention will be paid to the irrelevance of the consent of the victim, the punishability of the preparatory acts, authorship and participation, the controversial bankruptcy problems, international recidivism and, finally, the acquittal for the victim of trafficking in human beings.
