La regulación de la legitimación, activa y pasiva, en el art. 124 LRJS es una materia bastante compleja, toda vez que dicho precepto no solo regula la acción ordinaria de impugnación del despido colectivo y la acción de reconocimiento de la procedencia del despido a petición de la empresa, sino también, en su último apartado, el proceso de impugnación de las extinciones derivadas del despido colectivo, sin olvidar la posibilidad que tiene la autoridad laboral de impugnar el acuerdo alcanzado durante el periodo de consultas. En este trabajo se aborda el análisis de los diversos sujetos legitimados en las distintas vías de impugnación judicial que pueden sustanciarse para combatir el despido colectivo, con especial atención a la doctrina jurisprudencial recaída sobre la materia.
The regulation of active and passive legitimation in art. 124 LRJS is a very difficult matter, especially because that precept does not only regulate the ordinary action to fight the collective dismissal and the action to get the convalidation of the dismissal required by the company, but also the process to challenge the extinctions derived from the collective dismissal, without forgetting the possibility that the Labor Authority has to challenge the agreement reached during the consultation period. This paper analyzes the various subjects who have legitimation to act in the different procedural channels that can be substantiated to combat a collective dismissal, with special attention to the jurisprudential doctrine relapsed on the matter
