El legislador del año 2000 hizo frente a la difícil y compleja tarea de contemplar todas las situaciones que podrían suscitarse en la tramitación del monitorio, pero la realidad resulta siempre más rica en supuestos y ha conducido al legislador a efectuar no pocas modificaciones en estos 17 años de vigencia del texto procesal civil. Estas modificaciones han pretendido, no solo dar respuesta a problemas interpretativos sino también han adaptado el monitorio al estándar exigido en el monitorio europeo y asumido líneas jurisprudenciales consolidadas en el Tribunal Supremo. Este trabajo estudiará el monitorio haciendo hincapié en las razones que subyacen en esas reformas que, como se advertirá, no han sido pocas.
n 2000, the legislator faced the difficult and complex task of contemplating all situations that might arise in the processing of the order for payment procedure, but the reality is always richer in assumptions and has led the legislator to make a few modifications in these 17 years of validity of the text of the civil procedure. These changes have sought not only to respond to problems of interpretation but also to adapt that order for payment procedure to the standard required by the European order for payment procedure and to incorporate the consolidated case law in the Tribunal Supremo (Supreme Court). This paper will examine the European order for payment procedure with an emphasis on the reasons that underlie these reforms which, as it will be noted, have been numerous.
