    Este trabajo tuvo el propósito de destacar el basamento ético del orden jurídico y político del Estado moderno, sustentado en el reconocimiento de los derechos y las garantías instituidas en el derecho interno para precaver su libre ejercicio y hacer pasible su protección por medio de mecanismos procesales idóneos, céleres, inmediatos y diferenciados. Para ello se efectuó una investigación documental en la cual se siguieron los métodos del análisis cualitativo de documentos y la hermenéutica jurídica, a través de un diseño transversal o transeccional. Entre los hallazgos más significativos de la investigación, se aprecia que la naturaleza de los Derechos Humanos no obedece únicamente al criterio racionalista según el cual, se reputan como derechos fundamentales por estar incluidos en el Texto Político Fundamental, sino por representar las estructuras éticas y morales en las que se cimienta la legitimidad de un régimen jurídico-político.

    This work had the intention of emphasizing the ethical basement of the juridical and political order of the modern State, sustained in the recognition of the rights and the guarantees instituted in the internal right to anticipate his free exercise and to make his protection sensitive by means of procedural suitable mechanisms, céleres, immediate and differentiated. For it there was effected a documentary investigation in which followed the methods of the qualitative analysis of documents and the juridical hermeneutics, across a transverse design or transeccional. Between the most significant findings of the investigation, it appreciates that the nature of the human rights does not obey only the racionalist criterion according to which, they are considered as fundamental rights for being included in the Political Fundamental Text, but for representing the ethical and moral structures in which cimienta the legitimacy of a juridical-political regime
