La regulación constitucional de los municipios en Cuba: Principios históricos y comparados para su perfeccionamiento

    Ante las perspectivas de cambios legales en torno a la institución municipal en Cuba, conviene hacer un balance de aquellos elementos que deben ser objeto de cambio y de cuáles serían los referentes más pertinentes a considerar. Para ello en este trabajo se parte de un criterio cronológico, que comienza con un análisis de la historia dentro de la regulación constitucional cubana del objeto de estudio, para dejar sentados los puntos más altos de la tradición municipalista. Seguidamente se valoran los dictados de la vigente carta magna, a fin de determinar los elementos que requieren actualización y aquellos, que por sus méritos deben ser preservados. Por último, se expone cual es el estado de la materia en los textos insertos en el nuevo constitucionalismo latinoamericano, por considerarlos un referente a considerar en la materia.

    Faced with the prospect of legal changes around the municipal institution in Cuba, it should be done a balance of those elements that might be subject to change and what are the most relevant referents to consider. To do this work part of a chronological approach, beginning with an analysis of history within the Cuban constitutional regulation of the subject matter, to leave seated the highest points of the municipal tradition. Following the dictates of the current constitution are measured in order to determine the elements that require updating and those who by their merits should be preserved. Finally, it exposes what is the state of the matter in the texts inserts in the new Latin American constitutionalism, considering it as reference to consider in the matter.
