Los avances tecnológicos, entre ellos las llamadas pruebas genéticas predictivas, se asoman al proceso penal actual. Esta reflexión sobre el asunto examina esos instrumentos de cognición y, dentro de ellos, los test que tienen la misma destinación; además, se estudian los bancos de datos y las muestras genéticas y, con un punto de partida garantista, se clama por un control de estas herramientas de cara al proceso penal actual. Por ello, se hace un llamado de atención a la academia y a la administración de justicia para evitar que el uso de esos mecanismos propicie un derecho penal de autor que arrincone las garantías y dé paso al leviatán.
The Technological advances among the predictive genetic evidence appear in the current criminal process. This reflection about this subject, examines the instruments of cognition and, within them, the tests that have the same destination; In addition, this article analyze the data banks and genetic samples, and with a guarantee starting point it´s clamored for a control of these tools for the current criminal process.
For this reason, it is given an advice to the Academy and the Administration of Justice to avoid that the use of these mechanisms leads to a criminal law based on the perpetrator’s personality that shelves the guarantees and leave aside the Leviathan.
