  • In den letzten Jahren wurde die Rechtsstellung Kartellgeschädigter in Deutschland gestärkt. Dennoch bestehen weiterhin Hürden bei der Durchsetzung privater Kartellschadensersatzansprüche. Ein häufiges Praxisproblem ist hierbei die Verjährungsfristberechnung. Dies gilt insbesondere für langjährige Kartelle, die sich über mehrere Gesetzesnovellen erstreckten. Das diesjährige „Grauzementkartell II“-Urteil des BGH hat zwar eine rechtliche Unsicherheit beseitigt. Jedoch sind Kartellgeschädigte wie auch Kartellbeteiligte nach wie vor einigen verjährungsrechtlichen Unwägbarkeiten ausgesetzt. Auch wenn noch nicht alle Fragen gelöst sind, soll diese Abhandlung Rechtsanwendern einen Überblick im Verjährungsdickicht verschaffen. Until then, old regulations as well as new regulations must be applied to past antitrust cases. It is therefore highly welcome that the legislator of the 9th GWB amendment has created a transitional provision in § 186 GWB, which reduces legal uncertainty and corresponds with the general provisions of the intertemporal statute of limitation.
