Technologies have opened up unprecedented room for the development of human personality. Consequently, new rights of web users emerge, which the legal system is required to recognize. There is no awareness of this in the recent Italian law governing the investigative use of the so-called IT sensors. Written in the wake of the diatribes resulting from some Supreme Court case-law, the law only regulates the use of Trojan horses as means for bugging. In reality, the technical equipment available today allows to stretch searches, through an incredibly large variety of documents and Information, thereby obtaining a rich and varied picture of the daily habits of the controlled person. In addition to examining the legislative reform for what it says, this paper highlights what is not being said, in the hope that the procedural rules on IT detectors undergo a careful review.

Le tecnologie hanno aperto spazi inediti allo sviluppo della personalità umana. Correlativamente affiorano nuovi diritti dell'utente del web che l'ordinamento giuridico è tenuto a riconoscere. Di ciò non c'è consapevolezza nella recente legge italiana che ha regolato l'uso investigativo dei cosiddetti captatori informatici. Scritta sull'onda delle diatribe suscitate da talune pronunce della giurisprudenza di legittimità, la legge si limita a disciplinare l'uso dei trojan horses come mezzi di intercettazione ambientale. In realtà, la strumentazione tecnica oggi disponibile consente di spaziare con straordinaria e formidabile ampiezza nella raccolta di documenti e informazioni in grado di fornire un quadro ricco e variegato delle abitudini quotidiane della persona controllata. Oltre a esaminare la riforma legislativa per quel che dice, il presente contributo mette in evidenza quel che viene taciuto, auspicando un attento ripensamento della disciplina processuale sui captatori informatici.
