La exhaustiva relación de funciones que el vigente artículo 33 de la Ley Concursal encomienda a la administración concurso, no se ha visto acompasada con una revisión de los viejos presupuestos materiales requeridos para exigirles responsabilidad por daños ocasionados contra la masa del artículo 36.1 de la Ley Concursal. Con este trabajo pretendemos poner de manifiesto la necesidad de una nueva formulación de aquellos presupuestos materiales y hacer propuestas de lege ferenda que ayudarían a evitar que quedarse al albur de los intérpretes del Derecho modelo de conducta del artículo 35 de la Ley Concursal.
The exhaustive list of functions that the current article 33 of the Insolvency Law entrusts the insolvency administration, has not been accompanied by a review of the old material budgets required to demand liability for damages caused against the mass of article of the Insolvency Law.
