“Antígona” de Sófocles e a questão jurídica fundamental: a eterna tensão entre segurança jurídica e correção

    Sophocles’ Antigone has a prominent place in the Philosophy of Law. This tragedy expresses legal dilemmas and offers symbols that carry multiple interpretations. Throughout the centuries the work has been read, mostly, from a dualistic bias in which antagonistic pretensions of justice of Antigone and Creon collide – the satisfaction of one point of view implies the destruction of the other. However, François Ost offered a new interpretation of the tension proposed by Sophocles, finding a third moment in which the conciliation between opposites is possible. Such a moment would be occupied by the jurisdictional function in which hermeneutics would seek the best conciliation between the litigating parties. This research, after discussing an overview of Antigone’s plot and detailing Ost’s contribution, goes beyond Ost and argues from prominent names in contemporary Philosophy of Law (namely, Habermas, Alexy and Dworkin) that the tension present in Antigone is structurally analogous to legal issues faced throughout history.

    A Antígona de Sófocles possui um lugar de destaque na Filosofia do Direito. Essa tragédia expressa dilemas jurídicos e oferece símbolos que comportam múltiplas interpretações. Através dos séculos a obra foi lida, majoritariamente, a partir de um viés dualista em que pretensões de justiça antagônicas de Antígona e Creonte se chocam – a satisfação de um ponto de vista implica a destruição do outro. Entretanto, François Ost ofereceu uma nova interpretação à tensão proposta por Sófocles, encontrando um terceiro momento em que a conciliação entre os opostos é possível. Tal momento seria ocupado pela função jurisdicional em que o hermeneuta buscaria a melhor conciliação entre as partes litigantes. Esta pesquisa, após discutir um panorama geral de Antígona e detalhar a contribuição de Ost, vai além de Ost e argumenta a partir de nomes de destaque na Filosofia do Direito contemporânea (a saber, Habermas, Alexy e Dworkin) como que a tensão presente em Antígona é análoga estruturalmente a questões jurídicas enfrentadas ao longo da história.
