Resumen de La mediación en la jurisdicción contencioso-administrativa: dificultades para su implantación eficaz

Las alternativas a la judicialización de los conflictos intersubjetivos de intereses proliferan impulsadas por la necesidad de ofrecer soluciones ágiles al litigio, y enfrentar también por esta vía la problemática generada por el colapso de los órganos jurisdiccionales. La mediación intrajudicial cobra un protagonismo destacado entre las alternativas al proceso, muy relevante en el ámbito de la jurisdicción civil, gana progresivamente terreno en el marco de la jurisdicción penal. Sin embargo la jurisdicción contencioso-administrativa no ha resultado tradicionalmente receptiva a esta fórmula. Este trabajo se propone analizar las dificultades que empecen en este orden el éxito de las vías alternativas a la judicialización del conflicto, así como explorar el campo de actividad administrativa que pudiera resultar más favorable a una solución paccionada de la controversia.

The alternatives to the judicialization of the intersubjective conflicts of interests proliferate stimulated by the need to offer agile solutions to the litigation, and to face also for this route the problematics generated by the collapse of the jurisdictional organs. The intrajudicial mediation receives a protagonism emphasized between the alternatives to the process, very relevant in the area of the civil jurisdiction, gains progressively area in the frame of the penal jurisdiction. Nevertheless the contentious - administrative jurisdiction has not turned out to be traditionally receptive to this formula. This work proposes to analyze the difficulties that avoid in this order the success of the alternative routes to the judicialization of the conflict, as well as to explore the field of administrative activity that could be more favourable to a treaty settlement of the dispute.
