    La necesaria y urgente adaptación de nuestro ordenamiento jurídico a la Convención de los derechos de las personas con discapacidad exige que se revisen las instituciones clásicas de protección, los principios que justifican su puesta en marcha y las reglas que rigen actuación de las personas que ejercen las medidas. A estas exigencias da respuesta el Anteproyecto, consagrando, junto a la curatela y el defensor judicial, la guarda de hecho como una verdadera institución de protección, dotándola de un régimen jurídico que debe establecer los mecanismos que faciliten  la legitimación del guardador para realizar actos en beneficio de la persona y, a la vez, que existen las salvaguardias apropiadas para evitar los abusos, respetando, en todo caso, el principio que se impone como el núcleo y eje de la nueva regulación, la voluntad y preferencias de la persona.

    The necessary and urgent adaptation of our legal system to the Convention on the Rights of Persons with Disabilities requires a review of the classic protection institutions, the principles that justify their implementation and the rules that govern the actions of people who exercise the measures.

    To these demands the Preliminary Draft responds, consecrating, together with the curatorship and the judicial defender, the «de facto guard» as a true institution of protection, endowing it with a juridical regime that must establish the mechanisms that facilitate the legitimization of the guardian to perform acts in benefit of the person and, at the same time, that there are appropriate safeguards to prevent abuse, respecting, in any case, the principle that is imposed as the core and axis of the new regulation, the will and preferences of the person.
