Resumen de Discriminación por la diferencia indemnizatoria entre trabajadores fijos y trabajadores temporales o interinos: de la doctrina Diego Porras a la nueva doctrina Montero Mateos y Grupo Norte Facility, S.A.

El Tribunal de Justicia de la Unión Europea rectifica la doctrina Diego Porras con dos recientes sentencias: caso Montero Mateos y caso Grupo Norte Facility. Con esta nueva doctrina se confirma que no es discriminatorio que la normativa española no prevea el abono d e indemnización por finalización en los contratos de interinidad o que la indemnización sea inferior en contratos temporales. No obstante, la primera sentencia española que aplica la nueva doctrina –sustentándose en el apartado 64 de una de las sentencias del TJUE– mantiene la indemnización de veinte días de salario a interinos y temporales cuando se cumplan dos requisitos: no se conozca con certeza la fecha de finalización y, además, la relación se considere inusualmente larga –dos o tres años–.

The Court of Justice of the European Union rectifies the jurisprudential doctrine Diego Porras with two recent judgements: case Montero Mateos and case Grupo Norte Facility. With this new jurisprudential doctrine is confirmed that it is not discriminatory that the spanish regulations does not establish the payment of a compensation for termination in the employment contracts of the temporary workers or that the compensation is lower in fixed-term contracts. However, the first spanish judgement that applies the new jurisprudential doctrine –basing on the 64 section of one of the judgements of the CJEU– maintains the compensation of twenty days of wage to the temporary workers and to the workers who have fixed-term contracts when two requirements are fulfilled: when it is not known with certainty the date of termination and, moreover, when the working relationship is considered unusually long – two or three years–.
