Resumen de Análisis de la responsabilidad patrimonial del socio en sus relaciones con la sociedad cooperativa: fundamentos y límites

En el presente trabajo se pretende determinar la responsabilidad exigible al socio de una sociedad cooperativa andaluza por las deudas que se originan en el ámbito de actuación de la misma. Para ello, se analizarán las distintas relaciones jurídicas que vinculan al socio con la sociedad cooperativa, al objeto de establecer el régimen de responsabilidad aplicable en cada una de ellas. La proliferación de leyes autonómicas reguladoras de las cooperativas hace necesario circunscribir el estudio a la normativa aplicable a las sociedades cooperativas andaluzas, sin perjuicio de que en algún momento, por el interés que suscite una cuestión concreta, se aluda a la normativa estatal o aquella aplicable en otras Comunidades Autónomas. Por razones de extensión y por claridad expositiva, centramos el análisis en el régimen general de las cooperativas de primer grado y desde una perspectiva jurídica. Quedan excluidas por consiguiente las cooperativas de segundo y ulterior grado, así como aquellas cooperativas sujetas a legislación especial.

The article aim is to determine the liability required of the member of a cooperative society in Andalusia for the debts that originate in the field of action of the same. For this purpose, the different legal relationships that link the member with the cooperative society will be analyzed, in order to establish the liability regime applicable in each one of them. The proliferation of regional Acts regulating cooperative societies makes necessary to circumscribe the study to the regulations applicable to Andalusian cooperative societies, notwithstanding that, at some point, due to the interest aroused by a specific issue, we will refer to Spanish Act or to the other Autonomous Communities Acts. In order to limit the article extension, and for expository clarity reasons, we will focus the analysis on the general regime of first-degree cooperatives and from a legal perspective. Cooperatives of second and subsequent degree, as well as those cooperatives adhere to special legislation are, therefore, excluded.
