El art. 814.3 CC y los descendientes del descendiente instituido heredero pero premuerto al ascendiente testador, cuando aquellos no figuran mencionados en tal testamento. Reflexiones para una interpretación distinta de aquella norma*)

    El caso del testador que instituye heredero a un descendiente que luego le premuere, dejando (éste) descendientes –que lo son también de aquél, aunque de grado ulterior– que sin embargo no han sido mencionados en ese testamento, es un supuesto que ha preocupado desde siempre, y que ha generado en torno a él distintas propuestas de solución. Tras la introducción en nuestro Ordenamiento del actual art. 814.3 C.c. –y del art. 46.3 de la Compilación de Derecho civil de Baleares–, hoy es idea dominante, tanto en la doctrina como en la jurisprudencia, que la solución se articula a través de un derecho de representación. Pero esta idea, aunque mayoritaria, no es pacífica. Y sin embargo el supuesto problemático sigue planteándose, obligando a reconsiderar una y otra vez la cuestión. Se propone aquí una explicación distinta de la figura dispuesta en el art. 814.3 C.c

    The case of the testator who appoints a descendant as a heir, who later dies before the testator leaving descendants –which are also descendants of this one, although of a subsequent degree– who, however, have not been mentioned in that testament, is a situation that has worried at all times, and that has generated different solutions around it. After the introduction in our Law of the current art. 814.3 C.c. –and after the introduction of the art. 46.3 of the balear Civil Law Compilation–, the dominant idea in both doctrine and jurisprudence is that the mechanism provided in it is articulated through a right of representation. But, although this is the majority idea, it is not peaceful. And yet the case continues to arise, forcing us to reconsider the question again and again. Proposal of a different explanation of the mechanism provided in art. 814.3 C.c
