Resumen de Os Auxílios Públicos aos Clubes de Futebol

  This article focuses on the theme of State aid, more specifically, the public aid granted to football sports clubs, and how these, similar to what happens in the other markets where competition laws prevail, may conflict with the national and european imperative of an unrestricted competition, free from distortions. It is intended, above all, to understand if there is a real submission of sport to the discipline of competition law, and, similarly, if there is an effective control of state aid in what concerns to football clubs. The analysis stands out mainly because of the realization of the unique specificities of the sports sector, which is a market with its own distinctive characteristics, not verifiable in any other.

  Furthermore, it’s undeniable the importance that football, especially professional clubs, as well as the national teams of each country, assume currently for the community, as well as the media attention that they are involved in, by which it is useful and interesting an analysis from the perspective of competition to the normative paradigm that governs the relations between the State(s) and professional football clubs

  O presente artigo versa sobre a temática dos auxílios públicos, mais concretamente, as ajudas estatais concedidas aos clubes desportivos de futebol, e de que forma estas, à semelhança do que sucede nos restantes mercados onde prevalecem as leis da concorrência, podem conflituar com o imperativo nacional e comunitário de uma sã concorrência, livre de distorções. Pretende-se, acima de tudo, compreender se existe uma efetiva submissão do Desporto à disciplina da concorrência, e, da mesma forma, se existe um controlo eficaz dos auxílios públicos no que aos clubes de futebol diz respeito. A análise releva sobretudo pela constatação das especificidades únicas do setor desportivo, sendo este um mercado com características próprias e distintas, não verificáveis em mais nenhum outro. Para além disso, é inegável a importância que o futebol, mormente, os clubes profissionais, assim como as seleções nacionais de cada país, assumem para a comunidade hodiernamente, bem como o mediatismo em que estão envolvidos, pelo que se revela útil e interessante uma análise, sob o prisma da concorrência, ao paradigma normativo que disciplina as relações entre o(s) Estado(s) e os clubes profissionais de Futebol
