Resumen de Violencia de género y diversidad cultural: el ejemplo de los matrimonios forzados

La incorporación del artículo 172 bis al Código penal español ha abierto un interesante debate sobre los matrimonios forzados. La complejidad de esta práctica delictiva nos obliga a reflexionar sobre el propio concepto de matrimonio forzado, el objeto de protección o sobre los principales elementos que configura este tipo penal. El fuerte impacto de género de esta práctica y su relación con la diversidad cultural invita a abordar este análisis desde la perspectiva de género, con la finalidad de identificar si el legislador ha incorporado en la tipificación de estas conductas la dimensión de género y si ha tenido en cuenta las necesidades de las minorías culturales. A lo largo de este trabajo se llevará a cabo un estudio del delito de matrimonio forzado desde una perspectiva crítica, con la finalidad de extraer algunas conclusiones sobre la pertinencia del modo en que se ha articulado la intervención penal en esta materia.

The incorporation of article 172 bis into the Spanish Penal Code has opened an interesting debate about forced marriages. The complexity of this criminal practice forces us to reflect on the very concept of forced marriages, the object of protection or on the main elements that make up this type of crime. The strong gender impact of this practice and is relationship with cultural diversity invites us to approach this analysis from a gender perspective, in order to identify whether the legislator has incorporated the gender dimension into the classification of these behaviors and whether take into account the needs of cultural minorities. Throughout this work a study of the crime of forced marriage will be carried out from a critical perspective, in order to draw some conclusions about the relevance of the way in which criminal intervention has been articulated in this matter.
