    La escasa doctrina que ha analizado el artículo 101 del Código Civil español coincide en calificarlo de precepto oscuro; hecho éste que se constata sin mayores objeciones en una lectura detenida. Por ello, en este trabajo analizaremos la redacción literal del artículo así como las distintas interpretaciones que se han ido ofreciendo desde su incorporación al Código Civil en el año 1981.

    The authors that have analyzed article 101 of the Spanish Civil Code coincide in describing it as dark and confusing and this is easily observed after a careful reading. Therefore, in this work we will analyze the literal wording of the article as well as the different interpretations that have been offered since its incorporation into the Civil Code in 1981
