Between the end of the nineteenth century and the 1960s the segregation system (Jim Crow) of the United States touched every aspect of the lives of Blacks and Whites. One of the most controversial issues was the law that prohibited interracial marriages. In 1932, in the Kentucky Court of Appeals, the Theophanis married couple intended to use this law to dissolve their marriage. The object of this article is to analyze in depth the Theophanis divorce to reveal the inconsistencies of the judicial system and segregation system in the American family in the period studied.
