La cadena de decisiones del Tribunal de Justicia y de la Corte Constitucional italiana con ocasión del asunto Taricco plantean muchos de los problemas que conlleva la articulación de los sistemas europeo y constitucional de derechos fundamentales. Enmarcada en este contexto más amplio, la Sentencia del Tribunal de Justicia conocida como Tarico II (Sentencia de la Gran Sala de 5 de diciembre de 2017, Procedimiento penal c. M.A.S. y M.B., C-42/17) apunta hacia una evolución respecto de dos cuestiones concretas: la influencia de las tradiciones constitucionales comunes en la interpretación de la Carta y la posibilidad de que los tribunales nacionales apliquen parámetros constitucionales más exigentes cuando el Estado cuenta con un margen de decisión y no existe una armonización legislativa de tales estándares nacionales (en la senda de jurisprudencia Akerberg).
The chained decisions of the Court of Justice and the Italian Constitutional Court on the occasion of the Taricco case raise many of the problems involved in the articulation of the European and constitutional systems of fundamental rights. Framed in this broader context, the Judgment of the Court of Justice known as Taricco II (Grand Chamber, Judgment of 5 December 2017 Criminal proceedings against M.A.S. and M.B, C-42/17) points towards an evolution with respect two specific issues: the influence of common constitutional traditions on the interpretation of the Charter and the ability of national courts to apply more stringent constitutional parameters when the State has a margin of decision and there is no legislative harmonization of such national standards (following the solution in Akerberg Judgment).
