Resumen de La protección del inversor en proyectos de energías renovables ante los cambios regulatorios en el Sistema eléctrico español

Desde hace algunos años, el legislador español ha ido disminuyendo progresivamente las ayudas a productores de electricidad basada en fuentes de energía renovable, en aras de garantizar estabilidad económica a un sistema eléctrico que adolecía de un cuantioso déficit tarifario. Así, el presente trabajo tiene por objeto analizar las principales revisiones normativas en materia de retribución a renovables, especialmente las acontecidas en el período 2013-2014, y su posible afectación a principios del derecho consolidados en nuestro ordenamiento jurídico. Para ello, examinamos la respuesta de la jurisprudencia a los distintos recursos planteados por inversores afectados, siendo de especial relevancia los pronunciamientos de los órganos arbitrales internacionales definidos en el Tratado de la Carta de la Energía. Además, tratamos la más reciente doctrina en materia de arbitrajes intraeuropeos y su posible extrapolación a las controversias acontecidas en materia de energía.

For some years, the Spanish legislator has been progressively decreasing the promotion of the use of energy from renewable sources, in order to preserve economic stability in the electricity system and on the occasion of electricity tariff deficit. In this context, the purpose of this paper is to show the main regulatory changes in terms of remuneration for renewable energy facilities, especially in the period from 2013 to 2014, and the possible infringement of fundamental principles of law in the Spanish legal system. For that, we examine the response of the courts to the judicial appeals posed by the investors in renewable energy, with special attention to the international arbitration awards defined in the Energy Charter Treaty. Furthermore, we analyze the most recent CJEU decision on intra-EU investments arbitration and the possibility of application to energy disputes.
