Para la doctrina oficial de la Dirección General de los Registros y del Notariado la caducidad de la anotación preventiva de embargo impide la cancelación de las titularidades y cargas posteriores a dicha anotación, pese a que la adjudicación se haya realizado antes de la caducidad. Se analizan aquí los límites que para esa doctrina pueden representar el art. 71 LH y la jurisprudencia del Tribunal Supremo sobre esta materia.
According to the official doctrine of the Directorate General of Registries and Notaries, the expiration of the preventive annotation of the charge impedes the cancellation of the rights and burdens subsequent to annotation, even though the forced adjudication was done before the expiration. The limits to this doctrine represented by art. 71 of the Spanish Mortgage Act and the jurisprudence of the Supreme Court on this matter are analyzed in this paper.
