Jurisprudencialmente se ha interpretado que al deber de los progenitores de prestar alimentos al hijo menor es de aplicación el artículo 148 CC del régimen general de alimentos entre parientes, con la consiguiente imposibilidad, si éstos son asumidos por uno de ellos en exclusiva, de exigir al incumplidor el reembolso de los devengados con anterioridad a la fecha de su petición judicial. Esta interpretación debe, sin embargo, ser cuestionada y, a nuestro juicio, superada, atendiendo a que se trata de dos instituciones diferentes con lógicas y fundamentos absolutamente distintos.
Jurisprudence has interpreted that article 148 of the Spanish Civil code, which regulates the general regime of support between relatives, is applicable to the obligation of parents to give child support to their minor children. In the case of the child support being beard by only one of the parents exclusively, this leads to the impossibility to require to the non-compliant parent the reimbursement of the expenses incurred in the support of the child accrued before the date of their claim in court. This interpretation has to be questioned and, in our opinion, bypassed, taking into account that they are two different legal figures with completely different legal reasons and legal basis.
