La contaminación por hidrocarburos. El caso “Magdalena”

    El 15 de enero de 1999, se produjo en la República Argentina el derrame de hidrocarburos más imponente en aguas dulces. Este suceso marcó un hito histórico en la normativa que regula la materia en nuestro país, ya que estos desafortunados acontecimientos han impulsado a la Argentina a la posterior ratificación de los Convenios Internacionales que rigen la materia. De este modo, se intentará abordar en perspectiva histórica; las consecuencias jurídicas y sociales que acarreó el derrame ocurrido en las costas bonaerenses de la Ciudad de Magdalena, a fin de brindar un hilo de luz a la disyuntiva existente entre la remediación de los efectos negativos al ambiente y el daño a través del ambiente y cómo reaccionó la comunidad local frente a esta problemática jurídica que tantos problemas genera a la hora de hablar de daño ambiental.

    On january 15, 1999, occurred in Argentina spill more imposing hydrocarbons in freshwater, this event marked a milestone in the regulations governing the matter in our country, since these unfortunate events have prompted the Argentina to the subsequent ratification of international conventions governing the matter. Thus, we will try to address in historical perspective, the social and political consequences, legal and carried the spill occurred in the Buenos Aires coast of the city of Magdalena, in order to provide a thread of light to the existing trade off between remediation negative effects on the environment and damage through the environment, the local community how I react against this legal problem that generates many problems when talking about environmental damage.
