  Se analiza en este artículo la jurisprudencia del Tribunal Constitucional Federal alemán sobre la libertad de opinión o expresión (Meinungsfreiheit). Es indudable la autoridad y la influencia del Tribunal alemán en otros tribunales europeos, y de todo el mundo, tanto nacionales como internacionales. A partir de las previsiones del artículo 5 de la Grundgesetz, el TCF alemán concluye que, en un Estado social estructurado de modo plural, y basado en el concepto de la democracia liberal, cualquier opinión, también aquellas que difieren de las concepciones predominantes, es digna de protección. En una democracia, la libertad de expresión tiene carácter constitutivo.

  This work analyzes the jurisprudence of the German Federal Constitutional Court on the freedom ofopinion and expression (Meinungsfreiheit). Is no doubt about the authority and the influence of the German Court in other European courts, and of all the world, both national as international. Starting from the article 5 of the Grundgesetz, the German Federal Constitutional Court concludes that, in a Social State structured of mode plural and based in the concept of the liberal democracy, any opinion, also those that differ from them conceptions ruling, is worthy of protection. In a democracy, the freedom of expression has character establishing.
