    La Directiva 2012/13/UE relativa al derecho a la información e los procesos penales ha establecido normas mínimas comunes en lo relativo a los derechos de las personas sospechosas o acusadas a ser informadas sobre los derechos procesales, al acceso a los materiales del expediente y a recibir información sobre la acusación. Algunas de las dudas que genera la aplicación de dicho instrumento han sido en parte resueltas en dos recientes sentencias del TJUE. El análisis de las mismas ha permitido, en primer lugar, delimitar el sentido y alcance del derecho a recibir información sobre la acusación. Y, en segundo término, la regulación del juicio sobre delitos leves ha incorporado el derecho a recibir información sobre la acusación de conformidad con lo previsto por la Directiva.

    The Directive 2012/13/EU on the right to information in criminal proceedings has established common minimum standards for suspected or accused persons concerning the right to information about rights, the right of access to the materials of the case and the right to information about accusation. The Directive enforcement has provoked several doubts which have been partially solved by two recent judgements from the ECJ. The analysis of these judgements has enabled to clarify two important issues. First of all, it has permitted to determine the meaning and scope of the right to information abourt accusation. And secondly, it has been revealed as a suitable way to check whether the Spanish law, especially the rules of "lesser offence trial", has incorporated the right to be given all the information on the accusation according to the Directive.
