On the basis of the CJEU's case-law development in the field of unfair terms, this work presents a number of challenges for the legal practitioners to seek an improvement in consumer protection. In the aftermath of the Tomásová judgment, it has been established the conditions of State liability resulting from this infringement by national courts of their obligation to assess of their own motion the existence of an unfair term when they have available to them the legal and factual elements necessary for that task. However, the analysis of the Spanish rules to enforce State liability in those cases reveals a possible infringement of the principle of effectiveness. This conclusion might also be deducted from the Spanish regulation regarding State liability stemming from the application of a provision declared contrary to EU law. Other challenges would be to extend to all the fields of consumer law the achievements obtained in the area of mortgage contracts and to establish norms assuming certain important assertions of the CJEU doctrine in the matter of consumer protection.
