La existencia de grupo laboral de empresas presupone la del grupo mercantil. Además, aquel exige algún elemento adicional o patógeno que, dependiendo de su intensidad, podrá determinar que nos encontremos ya ante un grupo solo fisiológico, ya ante otro patológico, ya ante un empresario individual llamado a responder como tal por el manejo fraudulento que haya podido hacer del grupo. El status jurídico-laboral del profesional dentro de la empresa puede cambiar sustancialmente de llegar a ser considerado trabajador de grupo. La ley española de sociedades profesionales ha podido tener una importante incidencia en ese sentido, lo que será el objeto de un artículo independiente.
The existence of the group of companies for labour purposes presupposes the one of a corporate group in accordance with commercial law. In addition, the former requires some additional element or pathogen, which, depending on its intensity, could determine that we found ourselves either before a just physiological group or a pathological one or even in the face of an individual employer called to answer in such condition for any fraudulent management of the group that he could have performed. The legal labour status of the professional within the corporation can substantially change in case of him happening to be considered as a group employee. The Spanish law about professional companies can have had an important impact in that sense, which will be the subject of an independent article.
