Resumen de La seguridad social de los trabajadores fronterizos en el marco comunitario: incidencia de la reforma de los Reglamentos 883/2004 y 987/2009 en la acción protectora

El objetivo del presente trabajo es abordar la cuestión de la acción protectora de los trabajadores fronterizos, a raíz de la propuesta de reforma de los Reglamento (CE) nº 883/2004 y (CE) nº 987/2009 de coordinación de los sistemas de Seguridad Social, los cuales contienen distintas estipulaciones en relación a esta cuestión. Para ello, partiremos del examen del concepto de trabajador fronterizo en el marco normativo de la UE, sin olvidar el concepto que sobre esta categoría de trabajadores recoge la normativa española, y delimitando esta figura respecto de otros colectivos de trabajadores de los que claramente se diferencia. A partir de ahí, se examinarán las reglas o principios aplicables para determinar la legislación aplicable a dichos trabajadores en materia de Seguridad Social. Finalmente, analizaremos la acción protectora de estos trabajadores, deteniéndonos, al ser inabarcable en unas pocas páginas las distintas prestaciones a las que pueden acceder, en la prestación por desempleo, al ser ésta la prestación que mayores problemas ha venido planteando, al tener la misma una territorialidad más marcada y habida cuenta que sobre ésta van a recaer las principales modificaciones que se han llevado a cabo en la reciente propuesta de reforma de los referidos reglamentos comunitarios en relación con los trabajadores fronterizos.

The objective of this paper is to address the question of the protective action of frontier workers, following the proposal to reform Regulations (CE) nº 883/2004 and (CE) nº 987/2009 on the coordination of social security systems, which contain different Stipulations on this issue. To do this we will start with the examination of the concept of frontier worker in the EU regulatory framework, not forgetting the concept of this category of workers in Spanish legislation and delimiting this figure with respect to other groups of workers from which it clearly differentiates. From there, the rules or principles applicable to determine the legislation applicable to such workers in matters of Social Security will be examined. Finally, we will analyze the protective action of these workers, stopping us, being unpractical in a few pages the different benefits to which they can access, unemployment benefit, since this is the benefit that has been posing major problems, As it has a more marked territoriality and given that this will be the main changes that have been carried out in the recent proposal for reform of the aforementioned Community regulations in relation to frontier workers.
