Resumen de Alienação parental e subtração internacional de menores: a cooperação jurídica internacional para a salvaguarda de direitos dos filhos

  The paper aims to give an account of international child abduction, as a reflect of parental alienation syndrome. The description of the aspects of this legal phenomenon and their damages to the personal development of children who are victims of parental alienation were achieved through a qualitative methodology based on bibliographical research and international and national diplomas. Then, discuss the international child abduction as one of the main consequences of family disputes in global level relationships, highlighting both psychological and legal aspects related to parental alienation in the transnational sphere. After that, a comparison is made between a brief list of decisions involving Brazil, as well as the behaviour of the Brazilian Office of the General Attorney in the resolution of cases involving the international abduction of the children by one of their parents. In conclusion, the study reaffirms the importance of compliance with international treaties for the preservation of the physical and psychological well-being of the minors involved, and the search for a speed and proper safeguard of the affectivity in the family core, especially regarding the well-being of children.

  O presente artigo tem por escopo abordar a problemática da subtração internacional de menores, como reflexo da síndrome de alienação parental. Por meio de metodologia qualitativa, exploratória, com base em pesquisa bibliográfica e em diplomas internacionais e nacionais, inicialmente descreve os aspectos próprios de tal fenômeno fático-jurídico e sua prejudicialidade à formação individual dos filhos vítimas da alienação parental. A seguir, trata da subtração internacional de menores como uma das principais consequências advindas de litígios familiares em relações de nível global, frisando tanto os aspectos psicológicos quanto os jurídicos vinculados à alienação parental em nível transnacional. Por derradeiro, realiza-se um cortejo entre um breve rol de decisões que envolvem o Brasil, bem como a atuação da Advocacia Geral da União na resolução de casos que envolvem a subtração internacional de filhos por um dos seus genitores. O estudo reitera a importância do adimplemento a tratados interestatais para a preservação do bem estar físico-psicológico dos menores envolvidos, e a busca pela célere e adequada salvaguarda da afetividade do núcleo familiar, principalmente no que se refere ao bem-estar dos filhos.
