Las aporías del discurso utilitarista de la pena

    El discurso que el Perú ha elaborado para justificar la pena está conformado por el fin preventivo de la pena, principio de proporcionalidad, culpabilidad, dignidad humana, hu-manización de las penas, entre otros. El primer principio (fin preventivo) justifica el por qué debe castigar, mientras que los demás principios justifican el cómo se debe castigar. El problema está en el hecho de que el fin preventivo de la pena no es compatible con los demás principios. Y en esa medida, el discurso no es apto para justificar el castigo debido a que la incompatibilidad implica– a la luz de la teoría de la justificación –un castigo potencialmente totalitario, sin límites materiales: discursivamente irracional. Por lo que es necesario, elaborar un discurso que sea consistente con los principios limitadores del ius puniendi. En concreto sustituir el fin preventivo por un fin que encarne la defensa de los derechos humanos desde sus fundamentos.

    The speech that Peru has developed to justify the penalty consists of the pre-ventive purpose of the penalty, the principle of proportionality, guilt, human dignity, humaniza-tion of punishment, among others. The first principle (preventive purpose) justifies why should punish, while the other principles justifying how to punish. The problem is that the preventive purpose of punishment is not compatible with the other principles. And to that extent, the speech is not suitable to justify the punishment because the inconsistency implies –in the light of the the-ory of justification– a potentially totalitarian punishment without material limits. As necessary, prepare a speech that is consistent with the principles limiting the right to punish. Specifically replace the preventive purpose for a purpose which will embody the defense of human rights since its foundation.
