    Parece que en la sociedad española se está produciendo una creciente aceptación de la custodia compartida. Y nuestros tribunales (singularmente el Tribunal Supremo) han generalizado progresivamente la adopción de esta medida, a pesar de que queda limitada por la literalidad del art. 92 CC. Aquel resultado se está logrando mediante una particular técnica de concreción de conceptos jurídicos indeterminados, contenidos en las previsiones del Código civil sobre atribución de la guarda. Fundamentalmente se trata de la interpretación del interés del menor. También así se palía, en buena medida, la ausencia de una ley que lleve al Código la custodia compartida como regla general.

    The acceptance of the joint custody seems to be widespread among the Spanish society. Our courts (in particular, the Supreme Court) have gradually mainstreamed the adoption of this measure, despite being limited by the article 92 of the Spanish civil code (CC). This is accomplished through the specification of undefined legal concepts regarding the child custody assignment contained in the CC, and mainly by ascertaining the interest of the child. Consequently, we can claim that, to a large extent, the absence of a law that inserts the joint custody in the civil code as a general rule, is mitigated.
