De nuevo sobre el Derecho de Enmienda y de la aprobación de las leyes

    La Sentencia del Tribunal Constitucional 155/2017 resuelve un recurso interpuesto por las Cortes de Aragón contra la modificación de la Ley de Montes. Los motivos son dos. El primero es que la modificación se ha producido mediante la adición de varias enmiendas, que se referían la regulación de los recursos hídricos. La sentencia entiende que hay conexión entre una y otra materia, pues se incluyen dentro de los recursos naturales. El segundo motivo es que se ha prescindido en la tramitación de la ley del informe de la Comunidad Autónoma de Aragón, preceptivo según el Estatuto de Autonomía de Aragón. La Sentencia desestima este motivo, porque el Congreso de los Diputados solicitó el informe pero, a juicio de la Sentencia, no hubo diligencia suficiente por la Comunidad Autónoma que demoró el envío de aquel.

    In the Sentence of the Constitutional Court, number 155 in 2017, there are two main matters. The first matter is the importance of the amendments in procedure of making laws. There must be a special connection between bill and amendments proposed by members and passed by Parliament. Spanish Constitutional Court sentenced that there is a relation between mountains (mater if the bill), and rivers (mater of the amendments). The second mater is an instrument of cooperative federalism: reports of Regional Authorities, if State rules rivers. Spanish Constitutional Court sentenced that new state rules are correct, because Spanish House of Deputies tried to get Aragonese regional report, but it did not do it on time.
