En materia de guarda y custodia coexisten en nuestro sistema jurídico la normativa propia del Estado con la emanada de las Comunidades Autónomas con legislación civil foral o especial, lo que genera diversidad de trato para situaciones fácticas sustancialmente iguales. Multiplicidad de normas que se contraponen más o menos abiertamente al régimen común dado que, a excepción de la Comunidad Navarra, el resto de las Autonomías se decantan claramente a favor del régimen de guarda y custodia compartida, regulando además con detalle otras medidas relacionadas con el uso de la vivienda, gastos ordinarios y extraordinarios, pensión compensatoria y otras medidas directamente relacionadas con la ruptura de pareja. El cambio de criterio legal se justifica en las expectativas y deseos de los ciudadanos, constituyendo muy robablemente el germen de la proyectada reforma del Código Civil que se plasmó en el Anteproyecto que no llega a ver la luz, absolutamente necesaria para garantizar la igualdad de todos los ciudadanos ante la Ley con independencia de la Comunidad Autónoma en la que tengan su residencia.

In terms of custody coexist in our legal system the law of the State with the emanation of the Autonomous Communities with foral or special civil legislation, which generates diversity of treatment for substantially equal factual situations. Multiplicity of rules that are more or less openly opposed to the common system since, with the exception of the Community of Navarre, the rest of the Autonomies clearly favor the shared custody regime, and also regulate in detail other measures related to the use of housing, ordinary and extraordinary expenses, compensatory pension and other measures directly related to the breakup of partners. The change of legal criteria is justified in the expectations and desires of the citizens, most likely constituting the germ of the projected reform of the Civil Code which was reflected in the preliminary draft currently under way, absolutely necessary to guarantee the equality of all citizens before the Law independent of the Autonomous Community in which they have their residence.Constitution, competence, regional or special law, coexistence, equality.
