    La sentencia objeto de comentario tiene origen en la demanda interpuesta por la compradora de un perro de raza supuestamente caniche toy contra la tienda que se lo vendió. La demandante reclamaba a la tienda una compensación porque el perro no era de tal raza y no había sido inscrito en el Libro de Orígenes Español, además de una indemnización en concepto de vicios ocultos, por los tratamientos veterinarios a los que el animal tuvo que ser sometido en las semanas siguientes a su compra. La sentencia de la Audiencia Provincial estimó parcialmente el recurso, revocando en parte la sentencia de instancia.

    The commented sentence has its origin in the lawsuit brought by the buyer of a supposed toy poodle dog against the store that sold the dog. The claimant sued the store for compensation because the dog was not of that breed and it had not been registered in the Spanish Book of Origins, as well as payment for hidden defects, for the veterinary treatment that the dog had to undergo in the weeks after its purchase. The sentence by the Provincial Audience agreed in part with the appeal, overturning part of the lower court sentence.
