    The United Sections of the Corte di cassazione, in the present decision, contribute to standardize the system of personal prention to the guaranteed standards imposed by national and supranational sources. The straightforwardness and the clearness of the Court decision shows in a more marked way the different interpretative attitude adopted, instead, with reference to the in rem preventive measures, where different interpretative views, far from allowing effective protection of the proposed, are corfirmed.

    La Corte di cassazione, a Sezioni Unite, nella decisione in esame, contribuisce ad uniformare il sistema della prevenzione personale ai canoni di garanzia imposti dalle fonti nazionali e sovranazionali. Proprio la linearità e chiarezza del percorso intrapreso evidenzia in modo ancora più marcato il differente atteggiamento interpretativo adottato, invece, in riferimento agli strumenti di matrice reale, ove si confermano impostazioni interpretative distanti dal consentire una effettiva tutela del proposto
