    Il contributo esamina il problema del rapporto tra il mandato di arresto europeo e la tutela dei diritti umani. Dall’analisi dei più rilevanti cases law della Corte di giustizia dell’Unione europea è possibile notare una nuova sensibilità verso i diritti umani. Tuttavia, molti problemi restano irrisolti ed il margine di discrezionalità degli Stati è ancora troppo ampio

    The article deals with the problem of the relationship between the European Arrest Warrant and the protection of Human Rights. By the analysis of the most important European Court’s cases-law in this subject, it is possible to note a new sensitivity for human rights. Despite comforting developments, many problems are unresolved and mostly the discretion margin of States is always too large
