La historia de Brasil es marcada por variadas violaciones a los Derechos Humanos y consiguiente exclusión de algunos grupos sociales. En 1999, el fallecimiento de un paciente psiquiátrico internado en clínica vinculada a la red pública brasileña generó significativo conmoción social. La familia identificó que la víctima tenía diversas lesiones en su cuerpo, revelando tratos inhumanos y tortura durante el corto período de internamiento. Una vez que el Estado brasileño lo se dedicó a investigar el caso y a punir los responsables, la cuestión fue trasladada a la Corte Interamericana de Derechos.
El caso conocido como Ximenes Lopes vs. Brasil representó la primera condena del Estado brasileño en el sistema interamericano y generó significativos avances en el tratamiento de enfermedades mentales e inclusión social de los enfermos. No obstante, pasados varios años la situación empieza a degenerarse, destacando la necesidad de nunca olvidar los casos emblemáticos y estar siempre alerta en la protección de los Derechos Humanos.

The Brazilian history is marked by violations of the Human Rights and the consequent exclusion of social groups. In 1999, the death of one psychiatric patient in a hospital accredited to the Brazilian public system generated a huge social commotion. The family identified many signals of violence on the victim’s body, which reveals an inhuman treatment and torture during the period of hospitalization. Considering the omission of the Brazilian state in the persecution and punition of the officials, the question was moved to the Interamerican Court of Human Rights. The case known as Ximenes Lopes vs Brazil was the first condemnation of the Brazilian state in the Interamerican system and generated relevant advances in the treatment of mental illnesses and social inclusion of the patients. Even so, some years after, the situation seems to get worse, showing the necessity of never forgetting the leading cases and always be alert in the protection of Human Rights.
