  El derecho a la protección de datos es uno de los derechos fundamentales que gozan de la naturaleza de derecho de la personalidad y, en cuanto tal, se extingue con la muerte de su titular. Consecuencia de ello es que los datos de las personas fallecidas no pueden considerarse comprendidos en el ámbito de aplicación de la legislación sobre protección de datos. No obstante, se permite a ciertas personas y en ciertas condiciones solicitar el acceso, la rectificación o la supresión de los datos de otra persona ya fallecida al responsable del fichero, intentando conciliar el referido carácter personalísimo con la posibilidad de que éste conozca efectivamente el hecho del óbito y pueda proceder en consecuencia en base el principio de exactitud.

  The right to data protection is one of the fundamental rights that enjoy the right nature of the personality and, as such, is extinguished with the death of its owner. Consequence of this is that the data of the deceased can not be considered as falling within the scope of the data protection legislation. However, certain people and under certain conditions are allowed to the request access, the rectification or the deletion of the data of another deceased person to the person responsible for the file, trying to reconcile the aforementioned personal character with the possibility that he or she actually knows the fact of death and may proceed accordingly based on the principle of accuracy
