The implementation of the new European Regulation and its adaptation to the Spanish national regulations have raised, among others, the issue relating to the possibility of third parties processing personal data of those who include a profile and other comments on social networks or other public media. While there appeared to be no major problems of interpretation, however the legislative work and some recent judicial pronouncements force a reconsideration of the question. Thus, in this paper we analyse such judicial decisions and judgments, as well as the legal texts in force and the forthcoming, in order to determine which solution is applicable.
