Resumen de Développements récents de la jurisprudence espagnole en matière d’arbitrage

In this article, the author analyses recent developments in Spanish case law relating to arbitration, and in particular the doctrine originating from the ICC — misnamed, according to him — of the “extension of the arbitration agreement”; the annulment of the arbitral award when this is contrary to public policy and the interpretation of a “pathological” arbitration clause where the latter provides indistinctly for recourse to arbitration and to the courts.

Dans le présent article, l'auteur analyse les développements récents de la jurisprudence espagnole en matière arbitrale et, tout particulièrement, de la doctrine d'origine CCI — mal nommée, selon lui — de “ l'extension de la convention d'arbitrage ” ; de l'annulation de la sentence arbitrale lorsque cette dernière est contraire à l'ordre public et de l'interprétation d'une clause arbitrale pathologique qui prévoirait, d'une manière indistincte, le recours à l'arbitrage et à la juridiction étatique.
