O papel do sistema de justiça numa sociedade em anomia: constrangimentos e desafios em Portugal

    This study addresses the role of the system of justice when problems of institutional anomie occur, applying this reflection to the Portuguese case. After a brief presentation of the theory of institutional anomie, some signs of anomie in Portugal were identified, taking into account the cultural values associated with the American Dream, the economic pressures in Portuguese society, the situation of political and social institutions and the evolution of instrumental crime. In this context, it is shown that the justice system is called upon to play a crucial role in reducing the effects of anomie, that is to say, in the prevention of instrumental crime, in terms of its deterrent role in crime and its contribution to strengthening of political and social institutions. The analysis developed points to a strong relationship between the quality of the system of justice and: i) human development; ii) the subjective well-being perceived by citizens, that is, happiness. The results indicate that the Portuguese system of justice, compared to several European countries, presents weaknesses in dealing with the effects of anomie

    Neste estudo aborda-se o papel do sistema de justiça quando se verificam problemas de anomia institucional, aplicando essa reflexão ao caso português. Depois de uma breve apresentação da teoria da anomia institucional, identificaram-se alguns sinais de anomia em Portugal, tendo em conta a incorporação dos valores culturais associados ao Sonho Americano, as pressões económicas na sociedade portuguesa, a situação das instituições políticas e sociais e a evolução da criminalidade instrumental no país. Neste contexto concluiu-se que o sistema de justiça é chamado a assumir um papel crucial na redução dos efeitos da anomia, ou seja, na prevenção do crime instrumental, em termos da sua função dissuasora do cometimento de crimes e ainda do seu contributo para o robustecimento das instituições políticas e sociais. A análise desenvolvida apontou para uma relação forte entre a qualidade do sistema judicial e: i) o desenvolvimento humano; ii) o bem-estar subjetivo percebido pelos cidadãos, ou seja, a felicidade. Os resultados indicam que o sistema de justiça português, comparativamente a vários países europeus, apresenta fragilidades para lidar com os efeitos da anomia.
