    Se trata de analizar la irrupción de la llamada inteligencia artificial y de los robots en el mundo del Derecho, singularmente del Derecho civil, considerando críticamente la pretensión de equiparar una y otros a las personas en cuestiones tales como la autoría de obras del espíritu, la capacidad jurídica o la de obrar. De la actualidad de estos desarrollos da cuenta el Derecho de la Unión Europea, habiéndose redactado en la Comisión de Asuntos Jurídicos una Resolución del Parlamento Europeo con recomendaciones destinadas a la Comisión sobre normas de Derecho civil sobre robótica, de fecha 16 de febrero de 2017. Dicha Resolución se muestra favorable al tratamiento jurídico de la Inteligencia Artificial, sobre todo por las ventajas económicas que puede traer el «desarrollo de máquinas inteligentes y autónomas, con capacidad de ser entrenadas para pensar y tomar decisiones de manera independiente».

    The aim of this work is to analyze the emergence of robots and of so-called artificial intelligence in the world of law, specifically in Civil law. The attempt to equalize artificial intelligence with the treatment that human beings deserve is critically considered in matters such as the authorship of copyrighted works, the legal capacity legal management. The current status of these developments is reflected in European Union Law, and a Resolution of the European Parliament was drafted in the Committee on Legal Affairs with recommendations to the Commission on Civil law rules on robotics, dated February 16, 2017. This Resolution is favorable to the legal treatment of Artificial Intelligence, especially because of the economic advantages that the «development of intelligent and autonomous machines can bring, with the ability to be trained to think and make decisions by themselves».
