La discriminación por razón de edad vinculada al momento de la jubilación del trabajador: la objetividad, la razonabilidad y el juicio de proporcionalidad

    Este artículo de investigación estudia la discriminación por razón de edad vinculada al momento de la extinción-jubilación del trabajador –a propósito de la sentencia del TJUE de fecha 28 de febrero de 2018, C-46/17, asunto Hubertus John y Freie Hansestadt Bremen–. Para ello se hace referencia al contexto normativo –nacional, comunitario e internacional– y a las resoluciones judiciales del Tribunal de Justicia de la Unión Europea y Tribunal Constitucional, sentencias con las que se alcanza una construcción argumentativa que permite y justifica la discriminación por razón de edad sustentada en caracteres de objetividad y razonabilidad mediante un juicio de proporcionalidad que evalúa la relación existente entre la medida adoptada, el resultado producido y la finalidad pretendida.

    The discrimination because of the age linked to the moment of the retirement of the worker: the objectivity, the rationality and the judgement of proportionality This research article studies the discrimination because of the age linked to the moment of the termination-retirement of the worker –in relation to the judgement of the CJEU of 28th February of 2018, C-46/17, case Hubertus John y Freie Hansestadt Bremen–. Therefore, it makes reference to the normative context –national, European and international– and to the legal rulings of the CJEU and the Constitutional Court, judgements with what it reachs an argumentative construction with allows and justifies the discrimination because of age supported in characters of objectivity and rationality through a judgement of proportionality that evaluates the relation existing between the adopted measure, the produced result and the pretended purpose.
