Existe un cierto desacoplamiento entre las normas que regulan el despido por absentismo del empleado en el Derecho del Trabajo y de la Seguridad Social del ordenamiento español y las normas de discapacidad y discriminación del ordenamiento europeo, lo que se complica aún más con las recientes, confusas y desorientadas líneas jurisprudenciales defendidas por los tribunales nacionales y por el TJUE. Es por ello que el objeto de esta investigación se centra —a propósito de la sentencia del TJUE de 18 de enero de 2018, asunto C-270/16: Ruiz Conejero– en el estudio de este marco normativo y jurisprudencial, planteando una serie de conclusiones y propuestas lege ferenda con las que asentar el régimen jurídico vigente

The «reification» of the worker in the indirect discrimination against the disabled in matters of work absenteeism (Critical legal study on the CJEU judgement of 18 January 2018, case C- 270/16: Ruiz Conejero, and the Community acquis on discrimination and disability) It exists a decoupling between the regulation of the dismissal due to the work absenteeism of the worker in the Labour Law and Social Security of the spanish legal system and the regulation of disability and discrimination of the european legal system, what it complicates even more with the recent, confusing and desoriented jurisprudential lines defended by the national courts and by the CJEU. Therefore, the objective of this research focuses on the study of this regulatory and jurisprudential framework —in relation to the judgement of the CJEU of 18 of January of 2018, case C-270/16: Ruiz Conejero–, considering a series of conclusions and lege ferenda proposals with the aim of settle the current legal framework.
